These Terms and Conditions of Engagement as varied from time to time, without notice to you, form the contract between PatentYogi Ltd. and yourself (hereinafter called the “customer”). It is your responsibility to review these Terms and Conditions periodically, and if at any time you find them to be unacceptable, please do not use the PatentYogi.com site. BY USING THIS SERVICE YOU MUST BE AT LEAST 18 YEARS OF AGE AND YOU AGREE THAT YOU ARE LEGALLY ABLE TO ENTER INTO CONTRACT.

PatentYogi is registered in England and is developing Internet based, software automation tools and technologies to automate the search, accessibility, and automation of legal information, document generation, and processes (Materials). PatentYogi is not a law firm, does not provide legal services, and does not provide legal advice. PatentYogi does its best to make sure it’s data and content on the website is current and accurate but cannot guarantee the accuracy of the data on the site. The customer should carry out such checks and procedures as are necessary to ensure the suitability and accuracy before relying on the information on the site.PatentYogi receives information from publicly available sources, from Government and Patent Office sources and through Application Programming Interface to data and images.

Customers of PatentYogi should contact a registered patent or Intellectual Property(IP) attorney or agent in their local jurisdiction for opinions on any legal matters. PatentYogi offer patent and trade mark information and consulting services for searching, document generation and market research. In addition, PatentYogi provides an opportunity for customers to select services of a law firm or IP firm in the PatentYogi network that offerfiling and prosecution servicesadvertised on PatentYogi.com. Please refer to each of those law firm or IP firm terms and conditions of engagement for any such legal work. PatentYogi is not privy to legal services performed by these law firms or IP firms, and users are asked to directly contact and communicate with these law firms or IP firms to get confidential docket information.

Services provided through PatentYogi are quality controlled directly by patent attorneys or patent agents in the PatentYogi network, and PatentYogi has no access to data through these firms once the PatentYogi product is delivered. PatentYogi makes a sincere effort to verify the reputation, credibility, and qualifications of each law firm or IP firm advertiser that directly advertises on PatentYogi.com. However, PatentYogi does not have any control over paid search Google ads that might be displayed next to content on pages of its websites, as these advertisements are displayed on PatentYogi websites through a content network.

PatentYogi is not a legal referral service. PatentYogi is not a law firm. PatentYogicannot provide legal advice. Attorneys who advertise prices on PatentYogi.com pay to advertise their services on our site. As such, PatentYogi.com does not form an attorney-client relationship with any visitor to its patentyogi.com website. Customers ordering products from PatentYogi has the right to use whatever law firm or IP firm they desire for future use, analysis, filing and prosecution of a PatentYogi delivered product.

1. Ownership. This Site is owned and operated by PatentYogi. All right, title and interest in and to the data content provided on this Site, including but not limited to information, documents, logos, graphics, sounds, and images (the “Data content”) are owned either by PatentYogi or by its respective third party authors, developers, or vendors (“Third Parties”). Except as otherwise expressly provided by PatentYogi, none of the Data content may be copied, reproduced, republished, downloaded, uploaded, posted, displayed, transmitted, or distributed in any way and nothing on this Site shall be construed to confer any license or transfer of any of PatentYogi’s intellectual property rights, whether by estoppel, implication, or otherwise.

When you open an account to use or access certain portions of the PatentYogi website or service, you must complete the registration process by providing the complete and accurate information requested on the registration form. You are entirely responsible for maintaining the confidentiality of your password.You agree to notify PatentYogi immediately of any unauthorized use of your account, user name or password.

3. Data Protection TheCustomer gives PatentYogi permission to process the personal data provided. PatentYogi makes every effort to comply with its obligations under the Data Protection Act 1998. The Customer may at any time unsubscribe from PatentYogi or remove any of the information that PatentYogi stores about you by sending an e-mail to office@patentyogi.com or by mail toPatentYogi at the address outlined below.

4. Links to Third Party Sites. This Site may contain links to Web sites controlled by parties other than PatentYogi (the “Third Party Sites”). PatentYogi is not responsible for and does not endorse or accept any responsibility for the availability, the contents, the products, the services or the use of the Third Party Sites or any Web site accessed from a Third Party Site, or any changes or updates to such sites.

5. Rights and Responsibilities of PatentYogi. PatentYogi cannot make an absolute guarantee of system security; however we take reasonable steps to maintain security. If PatentYogi’s technical staff finds that files or processes belonging to a member pose a threat to the proper technical operation of the system or to the security of other members, PatentYogi reserves the right to delete those files or to stop those processes. PatentYogi may temporarily disable any user’s access in order to preserve system security. In all such cases, PatentYogi will contact the member as soon as feasible.

PatentYogi reserves the right to refuse service to anyone and to cancel user access at any time.

6. NO WARRANTY. THE SITE AND ALL DATA CONTENT AND MATERIALS PROVIDED ON THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. 8. Indemnification. You agree to defend, indemnify and hold harmless PatentYogi, its officers, directors, shareholders, employees and agents from and against any and all claims, liabilities, damages, losses or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the Site, services and the Data content.

9. Unsolicited Submissions.PatentYogi does not want you to submit confidential or proprietary information to it through this Site. You acknowledge that you are responsible for the submissions that you provide, including their legality, reliability, appropriateness, originality and content.

10. Compliance with Intellectual Property Laws. When accessing PatentYogi.com or using PatentYogi’s legal document preparation service, you agree to obey the law and you agree to respect the intellectual property rights of others. You use of the Service and the Site is at all times governed by and subject to laws regarding copyright, trademark and other intellectual property ownership. You agree not to upload, download, display, perform, transmit, or otherwise distribute any information or content in violation of any third party’s copyrights, trademarks, or other intellectual property or proprietary rights. You agree to abide by laws regarding copyright ownership and use of intellectual property, and you shall be solely responsible for any violations of any relevant laws and for any infringements of third party rights caused by any Content you provide or transmit, or that is provided or transmitted using your User ID.

11. Compliance with Export Restrictions. You may not access, download, use or export the Site or Data content in violation of local export laws or regulations, or in violation of any other applicable laws or regulations. You agree to comply with all export laws and restrictions and regulations of any agency or authority and to assume sole responsibility for obtaining licenses to export or re-export as may be required.

12. Payment Terms

The customer agrees to be bound by the payment terms stipulated on the website and for payment to be made prior to any work being performed. The customer agrees to pay all government taxes and duties, regardless of origin, that may apply to all payments to PatentYogi. Each party will be responsible for recovering his own entitlements in respect of pre-payments (for example in respect of VAT or sales tax).

13. Governing Law; Venue. By using this Site, you expressly agree that any disputes or claims shall be governed by and construed in accordance with English law and the jurisdiction of the English courts. These terms of use expressly exclude and disclaim the terms of the U.N. Convention on Contracts for the International Sale of Goods, which shall not apply to any transaction conducted through or otherwise involving this Site.

14. Force Majeure. Whilst PatentYogi agrees to use its best endeavours to perform the contract for the customer as specified, PatentYogi will not be responsible for any delays or failure to complete the contract which are beyond PatentYogi’s control and which could not have been reasonably predicted.

16. Trade Marks.PatentYogi, PatentYogi.com, the PatentYogi logo, all images and text, and all page headers, custom graphics and button icons are service marks, trademarks, and/or trade dress of PatentYogi. All other trademarks, product names and company names or logos cited herein are the property of their respective owners.

17. Acknowledgement. BY USING PATENTYOGI’S SERVICES OR ACCESSING THE PATENTYOGI WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND AGREE TO BE BOUND BY THEM.

I may obtain information regarding free or low-cost legal representation through a local legal aid foundation, Patent and Trade Mark Office, bar association, and I may also contact local law enforcement, a district attorney or a legal foundation if I believe that I have been a victim of fraud, the authorized practice of law or any other injury.
PatentYogi is not permitted to engage in the practice of law including providing any kind of advice, explanation, opinion, or recommendation to a consumer about possible legal rights, remedies, defenses, options, selection of forms or strategies.
If, prior to my purchase, I believe that PatentYogi gave me any legal advice, opinion or recommendation about my legal rights, remedies, defenses, options, selection of forms or strategies, I will not proceed with this purchase, and any purchase that I do make will be null and void.
PatentYogi exists solely within England. I agree that regardless of where I reside or where my browser is physically located, my viewing and use of PatentYogi occurs solely within England, and that all content and services shall be deemed to be served from, and performed wholly within England as if I had physically travelled there to obtain the service. I agree that English law shall govern any disputes arising from my use of this website, and that the courts of England shall have exclusive jurisdiction over any disputes.
PatentYogi has the right to source work from Third Parties whom perform parts or all of the provided services on a need basis if required without the customer’s approval.

I understand that I have the right to rescind any agreement for any PatentYogi services within 24 hours of execution by providing PatentYogi with a written statement to that effect. PatentYogi will make an effort to provide a refund of service charges even after this period to ensure user satisfaction.
